The first castle on the site was built around the 1220s, an earthwork fortification surrounded by a moat in the marshes to the south of the present building. That very basic defensive structure was replaced by a substantial castle, built by Sir Herbert de Maxwell around 1277.
Robert de Maxwell of Maxwell, Caerlaverock and Mearns (d. 1409) rebuilt Caerlaverock castle and was succeeded by Herbert Maxwell of Caerlaverock (d. 1420). The earliest mention of the lands of Caerlaverock is around 1160, when they were granted to the monks of Holm Cultram Abbey. [1] .
About 1445, Sir Herbert Maxwell of Caerlaverock was created a Lord of Parliament, and in 1455, on the forfeiture of the Douglases, he was granted Eskdale and Carlisle, the second title being somewhat dubious as Carlisle remained steadfastly in English hands.
Sir John Maxwell was with King David at his defeat at Nevilles Cross in October 1346 and was taken prisoner with his king. He died in captivity within the year and his son Sir Herbert became Lord of Maxwell. Herbert was restored to Caerlaverock by the English king in 1347 having first sworn fealty.
