The Slender Man (also spelled Slenderman) is a fictional supernatural character that originated as a creepypasta Internet meme created by Something Awful forum user Eric Knudsen (also known as "Victor Surge") in 2009. He is depicted as a thin, unnaturally tall humanoid with a featureless white head and face, wearing a black suit.
Several for-profit ventures involving the Slender Man have unequivocally acknowledged Knudsen as the creator of this fictional character, while others were civilly blocked from distribution (including the Kickstarter-funded film) after legal complaints from Knudsen and other sources.
Copyright is a legal right, existing in many countries, that grants the creator of an original work exclusive rights to determine whether, and under what conditions, this original work may be used by others. Despite his folkloric qualities, the Slender Man is not in the public domain.
Blue Isle Studios still owns the video game rights to Slender Man, as the developer of Slender: The Arrival. It seems they're still using it with the release of the mobile port and that potential sequel they've been teasing.
Sony currently owns the IP for Slender Man. It's still possible to create works involving Slender Man since no one can own the generic idea of a faceless man in a black suit. It's best to not call it Slender Man though.
