Right of subject access
- Pupils attending any type of school have a right of access under the Data Protection Act 1998 to their own information. This is known as the right of subject access, and it covers all personal data held about the data subject (ie. the information is not limited to the child’s educational record).

Under Data Protection legislation, the GDPR grants the right of access to pupils and those with parental responsibility for a pupil. Under education regulations, those with parental responsibility have the right to view a pupil’s education record.
How can individuals access education data? There are two distinct rights to information schools hold about pupils: The pupil’s right of access under Article 15 of the UK GDPR. The parent’s right of access to their child’s ‘educational record’. In England and Wales, this right only applies to maintained schools.
- Safeguarding. To keep children safe and make sure they get the support they need, you can share information with other schools and children’s social care teams.
- Sharing data with local authorities and government. Occasionally, you may need to share personal information about your pupils with local authorities, other schools or children’s services.
- Sharing data with other schools. If a pupil moves to another school, you should transfer their records to the new school. This includes the pupil’s common transfer file and educational record.
- What you need consent for. Before sharing any personal data, you need to identify the lawful basis. This may be consent from the individual. There may be some circumstances where it may not be appropriate to ask for consent, however.
