Diversion is an approach to preventing reoffending by finding alternatives to formal criminal justice proceedings. Diversion can occur at different points in the criminal justice system: at the point of arrest, before charges are made, or in court through alternative forms of sentencing.
‘Diversion schemes’ are police-led programmes that divert people caught committing minor offences away from the criminal justice system, to other measures instead. Drug offence diversion schemes usually apply to the possession of illegal drugs for personal use, or sometimes to minor supply or cultivation offences.
Diversion from prosecution is a formal decision by the Procurator Fiscal. On receipt of a police report the Procurator Fiscal can choose to divert the young person to a local social work team or other service provider. The provider should have specific expertise in working with young people.
