If you have been diagnosed with any disease that is caused due to exposure to asbestos, you can make an asbestos related compensation claim within 3 years of that diagnosis. If the affected person has died, then their dependants and/or family members can also make a claim.
If an asbestos disease claim has been started before the asbestos patient dies from their illness, provided it is still within three years of their being diagnosed with asbestos disease (or proceedings have already been issued), a claim can be continued on the deceased’s behalf.
Asbestosis claims can be dealt with on a provisional damages basis or on a full and final basis. A provisional award allows the Claimant to come back to Court for additional compensation, should the degree of disability increase significantly.
