The law of Virginia consists of several levels of legal rules, including constitutional, statutory, regulatory, case law, and local laws. The Code of Virginia contains the codified legislation that define the general statutory laws for the Commonwealth.
In Virginia, state laws are enacted by the Virginia General Assembly and are recorded in the Code of Virginia (VA Code). The Virginia General Assembly holds a special place in American history as the first representative assembly in the new world.
The Virginia constitution authorized the assembly to establish a judiciary—a state court system—but left the organization of the courts to the legislators. Local courts continued to function as they had during the colonial period.
In 1618 the council in London instructed the Virginia governor to initiate the first representative assembly in the colonies. It was felt that the colonists needed to have some voice in local affairs if order and economic prosperity were to be reestablished in the faltering colony.
