Other councils – generally those with a committee system form of governance – may have such a committee, but do not have to. Scrutiny committees have powers to require council officers and councillors to come and give evidence to them, to require information from the council.
The Localism Act 2011 (the 2011 Act) allowed councils to adopt a non-executive form of governance, the Committee system. Councils who adopt the committee system are not required to have overview and scrutiny, but may do so if they wish – see the Local Authorities (Committee System) (England) Regulations 2012.
