The benefit of having your arrest record sealed is that it deletes the information from your RAP sheet (your official criminal record kept by the state), so even law enforcement officers will NOT be able to see the information in most cases.
May 30, 2023 · Sealing an arrest means the record will not show up on most criminal background checks, and that records of arrest such as police reports, fingerprints, booking photos and rap sheet entries will be deleted. The law originated as California Senate Bill 393. SB 393 is now codified in Penal Code 851.87 PC.
Fortunately in California, pursuant to Penal Code 851.8, there is a process by which an individual can seal and destroy his or her arrest records. Once your arrest records have been sealed and destroyed, all the records (including police reports, fingerprints, rap entry and booking photos) are deleted.
