    The Mental Capacity Act calls this a deprivation of liberty. Being deprived of liberty means that you’re not free to go anywhere without permission or close supervision. It also means that you’re continuously supervised. This is against the law unless it's done under the rules of the Mental Capacity Act.

    • The Deprivation of Liberty Safeguards are an amendment to the Mental Capacity Act 2005. They apply in England and Wales only.
    • The Mental Capacity Act allows some restraint and restrictions to be used – but only if they are in a person’s best interests and necessary and proportionate.
    • Extra safeguards are needed if the restrictions and restraint used will deprive a person of their liberty. These are called the Deprivation of Liberty Safeguards.
