Nov 18, 2002 · The idea of a Pure Theory of Law was propounded by the formidable Austrian jurist and philosopher Hans Kelsen (1881–1973) (see the bibliographical note). Kelsen began his long career as a legal theorist at the beginning of the 20th century.
It argues that the Pure Theory is best understood as an attempt to find a middle ground between natural law and legal positivism that may serve to reconnect positivist legal thought — in a distinctive and so far unexplored way — with normative political theory.
These parts of Kelsen's oeuvre suggest that the Pure Theory is driven by the normative ambitions of offering a defence of the rule of law, of democracy, of constitutionalism, and of international legalization.
