Under Title IV-D of the Social Security Act (referred to as “Title Four-D”), the friend of the court (FOC) office and the Office of Child Support (OCS) must begin support enforcement action when child support payments greater or equal to one month’s support become past due. Overdue support is called “arrears.”.
Once a criminal charge has been brought, you cannot have it dropped or reduced. Any charge reduction is in the discretion of the Attorney General's office. As a result of prosecution, the Non-Custodial Parent may go to jail or prison and would not be paying child support while incarcerated.
