Under the Sentencing Council’s guidelines for sexual offences which includes indecent images of children, indecent images offences are grouped into three categories: Category A – Images involving penetrative sexual activity, sexual activity with an animal, or sadism. Category B – Images involving non-penetrative sexual activity.
The law is governed under section 1 of Protection of Children Act 1978. Whether someone will go to prison for possession of indecent images depends on a number of factors. Indecent images fall into 3 categories of seriousness. Category A – This relates to images involving penetrative sexual activity, sexual activity with an animal or sadism.
The indecent images ofences have a statutory maximum of five years’ imprisonment for possession of images and 10 years’ imprisonment for the distribution, taking or making of such images. Sentences passed for an ofence cannot be higher than the statutory maximum. The definition of ‘child’ for these ofences is anyone under 18 years of age.
